Responding to a government tender: the compliance matrix, the criteria and a conforming offer

A government tender response is marked, not read: an evaluation panel checks the mandatory criteria first, then scores each weighted criterion against what you wrote under it, and it cannot give marks for things it could not find. The compliance matrix, a table of every requirement in the documents with where and how you meet it, is the tool that turns the buyer's structure into yours. Build it before writing a sentence, write under the buyer's headings, meet every mandatory item, and lodge a conforming offer before you add an alternative one.

Read the documents the way the evaluators will

The invitation usually has a conditions document, a specification or statement of requirement, the response schedules and the draft contract. The evaluators work from the conditions document's criteria and the schedules. Find four things first: the mandatory criteria (pass or fail), the weighted criteria and their weightings, the response format and page limits, and the lodgement method and closing time. Everything you write serves those four.

Build the compliance matrix

List every requirement in the documents, one row each: the clause or question reference, the requirement in the buyer's words, whether it is mandatory or weighted, where in your response you answer it, and the evidence you will attach. The matrix does three jobs: it stops you missing a requirement buried in the specification, it lets a reviewer check the response in an hour, and many buyers ask for it as a schedule. Fill the mandatory rows first; an unmet mandatory criterion ends the evaluation of your offer no matter how strong the rest is.

Write under the buyer's headings, with evidence

Answer each criterion under its own heading, in the order the buyer set, and lead each answer with the claim the criterion is testing, then the evidence: the contract, the year, the buyer, the outcome, the certificate, the named person. Evaluators score what they can verify. Adjectives are not scored; a past-performance table is. Where the criterion is a plan (methodology, program, transition), give the plan with dates and responsibilities, not a description of your general approach.

In Queensland, the purposeful public procurement criterion is scored only on how your response contributes to the outcomes the tender names, so answer those outcomes with commitments that carry numbers. The guide on that criterion has the list.

Conforming and alternative offers

A conforming offer meets every mandatory requirement and the specification as written. An alternative offer proposes a different way to deliver the outcome. Rule 16 of the Queensland Procurement Policy tells agencies not to require a conforming offer before considering an alternative one and not to write mandatory criteria that shut out innovation; other jurisdictions vary, so read the conditions. The safe practice is still to lodge the conforming offer, and to lodge the alternative as a clearly labelled second offer if the conditions allow it.

Questions, addenda and lodgement

  • Use the questions period. A question answered by addendum is answered for every bidder; a guess is answered for none.
  • Addenda usually go only to registered downloaders. If the documents changed, the compliance matrix changes.
  • Respect the page limits and the file formats; a schedule over the limit is often not read past it.
  • Lodge early on the portal the invitation names, in the portal's own time zone, and keep the lodgement receipt. A late offer is not opened.
